Agreement and eligibility
By visiting the site, creating an account, listing or buying an item, bidding, subscribing, or using seller tools, you agree to these Terms and the linked policies. Buyers under 18 may use the service only with the authorization and supervision of a parent or legal guardian who accepts responsibility for the transaction. Seller, employee, and privileged accounts must be held by a person who is at least 18 and legally able to enter the applicable agreements.
Accounts and identity checks
Provide accurate, current information and protect your password, passkey, email account, and device access. Seller, employee, and privileged accounts may require email ownership, a unique User ID, legal-profile details, and identity verification through Stripe Identity before access is activated. A successful identity check does not guarantee continued access if other eligibility, safety, or policy requirements are not met.
Marketplace, streams, and auctions
Sellers are responsible for accurate titles, descriptions, condition details, inventory, auction settings, fulfillment, and legal compliance. Buyers are responsible for bids and purchases placed through their accounts. A winning bid or accepted purchase is binding unless the listing, checkout, mandatory law, or these policies allow cancellation. We may pause a stream, auction, listing, payout, or account to investigate safety, fraud, ownership, payment, or policy concerns.
Products and collectible risk
Products may include sealed trading-card products, packs, boxes, tins, cases, singles, graded cards, promotional items, memorabilia, and related collectibles. Images may be representative. Manufacturer packaging, artwork, inserts, and randomized contents may vary. No sealed or randomized product guarantees a particular card, rarity, grade, market price, or resale value. Opening or live-ripping a sealed product changes its return eligibility.
Prices, inventory, and orders
Prices, bids, fees, taxes, shipping charges, credits, and subscription details are shown before the applicable purchase. Prices may change before checkout is completed. An automated confirmation acknowledges the transaction; it does not prevent cancellation and refund for a pricing error, unavailable inventory, suspected fraud, shipping restriction, duplicate order, or other inability to perform. Inventory may be held temporarily while checkout is open.
Subscriptions and stream credits
Seller subscriptions renew at the interval and price displayed at checkout until cancelled. Included stream credits, overage pricing, purchased credits, rebate rates, finalization delays, expiration dates, and cash-out eligibility are governed by the plan shown at purchase and the Refund Policy. Subscription charges are non-refundable after a billing period begins except where required by law or where Crack Packs confirms a duplicate charge, unauthorized charge, or platform billing error. Cancelling prevents future renewal according to the cancellation date shown in the Stripe customer portal; it does not itself reverse an already completed subscription payment.
Lifetime Beta seller program
The Lifetime Beta seller program is limited to 1,000 unique verified people across all invitation links. A valid invitation reserves eligibility while space remains; the first eligible paid Beta seller subscription locks access to the protected Beta price schedule for that verified account. Switching tiers applies the selected tier's displayed Beta price. It does not make service free, guarantee that every plan remains available, or create a second entitlement for a duplicate identity. Existing paid subscriptions keep their assigned Stripe Price until changed or cancelled.
A Lifetime Beta member with an active paid seller subscription receives the highest published referral tier for that subscription month. This monthly benefit does not create fake referrals, alter the verified-referral count, promise a particular prize value, or survive a cancelled, unpaid, or expired subscription month. Fraud, duplicate identity, payment reversal, or manipulation may result in review or revocation consistent with these Terms and applicable law.
Payments, promotions, and payouts
Stripe processes payments and may process seller payouts or billing changes where enabled. Crack Packs does not receive full payment-card numbers. Reward, referral, promotional, and account-credit offers are personal and may be limited, non-transferable, non-refundable, or subject to expiration as disclosed. They have no cash value unless the account specifically marks an amount as cash-out eligible.
Shipping, returns, and refunds
The Shipping Policy, Return Policy, and Refund Policy are part of these Terms. International shipments use DAP terms unless checkout expressly states otherwise. Mandatory consumer rights remain in effect.
Acceptable use
Do not create false or duplicate identities; access another person's account; manipulate bids, auctions, referrals, reviews, credits, or prices; list counterfeit, stolen, restricted, or unlawfully obtained goods; test stolen payment credentials; scrape private data; interfere with streams or site operation; evade restrictions; threaten users; or use the service for unlawful conduct.
Content and intellectual property
Crack Packs branding, original artwork, site text, and code are protected. By uploading a listing image, show thumbnail, description, or stream content, you confirm that you have the necessary rights and grant Crack Packs a non-exclusive license to host, display, resize, and distribute that content as needed to operate and promote the listing or show. Trading-card names and third-party marks belong to their owners. Crack Packs is an independent marketplace and retailer and is not endorsed by Pokémon, Nintendo, Creatures, Game Freak, Wizards of the Coast, Stripe, EasyPost, Cloudflare, or any carrier.
Suspension and termination
We may limit or close access when reasonably necessary to protect users, investigate suspected fraud, comply with law or provider requirements, enforce these Terms, or address security risks. Account closure does not erase completed payment, order, tax, dispute, payout, or legal records that must be retained.
Disclaimers and liability
To the extent permitted by law, the service is provided without implied warranties beyond those that cannot legally be excluded. Crack Packs is not responsible for collectible market-price changes, seller or buyer conduct outside platform controls, carrier or customs delays outside its control, third-party service outages, or indirect or consequential loss. Nothing limits statutory consumer rights or liability that applicable law does not permit us to limit.
Changes, disputes, and contact
We may update these Terms prospectively by posting a new effective date. The law applicable to Crack Packs governs without overriding mandatory rights that apply where you live. Before filing a claim, contact support@crackpacks.com so we can investigate and try to resolve it.
